Terms of Use

Version: October 23, 2026

These terms explain how you may use Games by Hyper products and what to expect when purchasing from our website. They cover digital products, support, subscriptions, refunds, and AI training restrictions. For purchase or license questions, contact support@gamesbyhyper.com.

Games by Hyper, Europalaan 400, 3526 KS Utrecht, the Netherlands. Chamber of Commerce (KVK): 66509084. VAT number: NL002283930B70.

1. Purchases and applicable terms

The product description, license option, supported engine versions, price, and any payment schedule shown when you place your order form part of your purchase. Check these details before buying. A product-specific license or written agreement takes priority over these general terms where they differ.

If you purchase on behalf of a business, you must have authority to bind that business and select a license covering its use. Prices, applicable taxes, and the amount payable are shown before you confirm the order. Keep your order confirmation as evidence of your purchase and license.

Purchases through Fab or another marketplace remain subject to the license and purchase terms applicable there. Buying directly from Games by Hyper does not create a purchase on Fab or automatically grant access through the Epic Games Launcher.

2. Using our products

Subject to your applicable product license and payment obligations, you may use and modify the products you acquire for personal and commercial projects. You may distribute completed games and other projects containing the products as integrated components, provided that end users cannot extract and reuse our products as standalone development assets.

You retain ownership of your own original work. Games by Hyper and its licensors retain ownership of the supplied products. Acquiring a product gives you a license to use it, not ownership of its underlying intellectual property.

The license is non-exclusive and applies to the purchasing person or business. It does not permit transferring the product license to another person or business, except where a specific license or mandatory law permits it. Third-party components, including Epic-provided or open-source material, remain subject to their own license restrictions and attribution requirements.

Website license tiers

  • Individual: solo creators and teams of up to 2 people with annual business revenue of no more than US$100,000.
  • Studio: teams of 3 to 10 people, or businesses with annual revenue above US$100,000 and no more than US$2 million, provided they do not meet the Enterprise criteria.
  • Enterprise: teams of more than 10 people, or businesses with annual revenue above US$2 million.

Choose the highest tier required by either team size or revenue when purchasing. Count the people who will work with the licensed product, including contractors with source access. A license held by an individual does not cover a larger employer or client that requires a different tier. A separately agreed studio or enterprise contract governs any custom scope.

These are Games by Hyper website tiers, not Fab's Personal and Professional tiers. The license recorded with your purchase governs that purchase. Later changes to our tier descriptions do not retroactively reduce your rights; new purchases must use the tier appropriate at that time. Contact us before expanding source access beyond the team scope of your existing license.

3. Team access and redistribution

You may give employees and contractors access to product files only as permitted by your license and only to work on your projects. Respect any seat or team limits attached to your purchase. Keep files in private, access-controlled storage, and ensure that collaborators do not retain or reuse them for unrelated projects without their own license.

You may not resell, sublicense, publish, or redistribute our products or modified versions as standalone assets, templates, modules, source repositories, or competing asset packs. Do not share account credentials, download links, or license keys to give unlicensed users access. Sharing a finished game does not permit sharing its underlying Hyper source files.

4. Compatibility, support, and updates

Use the engine versions and dependencies listed for your product. Integrating modules into an existing project may require development experience and project-specific changes. Compatibility with every third-party asset, modified project, or future engine version is not promised.

Standard support includes the documentation, available tutorials, and bug-report channels described in our documentation and support guidelines. Custom integration, individual training, and fixes for issues introduced by your own modifications are separate services unless expressly included in your purchase. Any published support or update commitment for your product remains applicable.

  • Community support channels are available after purchase verification. Bug fixes are prioritized by their impact.
  • Our published standard engine-update commitment is at least 3 years from a product's initial publication, or until a major engine change such as UE6, whichever comes first, unless the product has a different stated commitment. Mandatory update obligations still apply.
  • Standard support does not include custom integrations, adapting unrelated third-party assets, general Unreal Engine training, personal calls, or debugging faults caused only by your changes.
  • Optional advice or extra help provided without charge does not create an ongoing custom-support commitment. Paid support blocks, onboarding, and implementation services include only the scope expressly purchased or agreed.

Products are supplied with their advertised features, not a promise to implement every requested feature. Unless expressly included, future features, custom work, response times, and support for new major engine generations are not guaranteed. Keep backups and use version control before integrating products or installing updates.

5. Refunds and consumer rights

For purchases made on this website, contact support@gamesbyhyper.com with your order number, product name, engine version, and a description of the issue. For technical faults, include reproduction steps and relevant screenshots so we can investigate and offer an appropriate remedy.

Our voluntary refund policy focuses on reproducible technical faults that prevent a product's main advertised features from working. We may first help you reproduce the problem in a supported, unmodified setup and provide a fix where appropriate. This process does not delay or replace any remedy required by law.

We do not offer a voluntary refund solely because of:

  • Technical misunderstanding, insufficient Unreal Engine or programming experience, or difficulty learning or understanding a product.
  • Needing to modify the product, perform custom integration, or adapt it to a specific project or third-party asset.
  • Problems introduced by your own changes, unsupported engine versions, or missing requirements that were accurately disclosed before purchase.
  • Expectations about features, ease of use, performance, appearance, or support that were not promised in the product description.
  • Minor visual imperfections or ordinary engine and network limitations that do not prevent the advertised functionality.
  • A change of mind, an abandoned project, or a price change or sale after purchase.

These exclusions apply only to our voluntary refund policy. They do not exclude remedies for a product that is faulty, misdescribed, or otherwise fails to meet applicable legal requirements. Calling a problem a misunderstanding does not remove your rights if our description or instructions were inaccurate.

Your statutory consumer rights take priority over these terms. Where a withdrawal period applies to a digital download, it is lost on early supply only if the legally required prior express consent, acknowledgement of that loss, and confirmation have been obtained. Reading or accepting these general terms alone does not waive that right. Contact us to exercise any applicable withdrawal or refund right.

For purchases made through Fab, use the Fab refund process and policy. Contact us first for help with product faults. Fab determines refunds under its own rules, including any eligibility for products that have not been downloaded; our website's voluntary refund criteria do not replace those rules.

If a purchase is fully refunded and its license ends, stop using the refunded material and remove copies from your projects and repositories unless the refund decision or applicable law allows continued use. A partial price reduction does not by itself end your license.

6. Subscriptions and services

The selected subscription plan and checkout show the billing period, price, renewal terms, and included benefits. Cancelling a subscription stops future renewals; benefits remain available until the end of the paid period as described for your plan. Cancellation does not automatically refund the current period, but applicable statutory rights remain unaffected.

Loyalty credits are account-bound benefits, not cash, and cannot be transferred or exchanged for money. Their validity and eligible rewards are described in the subscription information. Custom services are governed by their agreed scope and delivery terms. A payment plan for a product purchase is subject to its own agreed payment schedule and is not automatically cancelled by cancelling a separate membership subscription.

Subscriptions, loyalty credits, and reward redemptions are not voluntarily refundable unless the offer says otherwise. This does not limit statutory withdrawal rights or remedies for non-performance. Cancelling membership does not by itself cancel a separately purchased product license.

7. No AI training

Our proprietary products and content may not be used to train AI models or build AI training datasets. This includes training for personal, research, internal business, and commercial purposes, subject to the legal exceptions described below.

Material covered

This policy covers proprietary material owned by Games by Hyper, including paid and free products, source code, Unreal Engine Blueprints, templates, systems, assets, project files, documentation, tutorials, videos, and website content. Purchasing, downloading, or accessing this material does not grant AI training rights.

Prohibited AI training uses

You may not use our covered material, or copies, extracts, or modified versions of it, to:

  • Train, pre-train, fine-tune, or otherwise update the learned parameters of an artificial intelligence or machine learning model.
  • Create, compile, enrich, sell, share, or contribute to datasets intended for model training or fine-tuning.
  • Generate synthetic training data or distill a model using our material as source material.
  • Scrape, extract, or mine our material for any of these purposes, or provide it to another person or service for these purposes.

These restrictions apply to both public and private models, including models running locally. They also apply when training is performed by a third party on your behalf.

Using AI tools in your own project

You may use AI tools to help understand, integrate, debug, or adapt products you are licensed to use in your own project, provided that the use remains within your product license and the tools do not use the supplied material for model training or fine-tuning.

Before supplying our material to an AI service, check that its terms and settings exclude that material from training and do not make it available to other users. Do not submit it to services that reserve the right to train on it. This permission does not allow publishing our source files, sharing access with unlicensed users, or distributing our products as standalone assets.

Product licenses and third-party material

Your applicable product license continues to govern ordinary use, modification, and distribution in your projects. This policy does not expand those rights or replace the other terms of that license.

Third-party and open-source components remain governed by their own licenses. For purchases made through a marketplace such as Fab, the license and terms applicable to that purchase govern; this page does not retroactively change them or override rights already granted under them.

Reservation of rights

Games by Hyper expressly reserves its rights in the covered material for text and data mining carried out for AI training, fine-tuning, or training dataset creation, including under Article 4(3) of Directive (EU) 2019/790 where applicable. Public availability is not permission for these uses.

Nothing in this policy restricts uses that applicable law permits and that cannot lawfully be excluded, including applicable mandatory research exceptions. No AI training license is granted by this page.

8. Responsibility and legal rights

You are responsible for testing your project, securing access to product files, and ensuring that your own additions and distribution comply with applicable laws and third-party licenses. We do not guarantee that a project will be profitable, achieve a particular result, or work with every configuration. This does not reduce our responsibility for the features and commitments we actually advertise.

To the extent permitted by applicable law, we are not responsible for indirect business losses, such as lost profits or opportunities, resulting from use of our products. No exclusion in these terms applies to fraud, deliberate misconduct, death or personal injury caused by negligence, or any liability or consumer remedy that cannot legally be excluded.

For a material license breach, we may require you to stop the prohibited use. Where the breach can reasonably be corrected, we will give notice and a reasonable opportunity to correct it before terminating the affected license. Any termination must respect applicable law and does not automatically cancel unrelated purchases.

9. Privacy, changes, and disputes

Our Privacy Policy explains how we handle personal data. We may revise these terms for future purchases. Changes do not retroactively remove rights granted with an earlier purchase. Mandatory legal rights and any separately agreed terms remain unaffected.

These terms are governed by Dutch law. If you are a consumer, this choice does not deprive you of mandatory protections under the law of your country of habitual residence where those protections apply. Disputes may be brought before the courts competent under applicable law; nothing here requires a consumer to waive a legally protected right to use their local courts.

Please contact support@gamesbyhyper.com first with complaints so we can try to resolve them. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
